California braces for more stormy weather

SAN FRANCISCO (AP) ? Northern California is bracing for more stormy weather this weekend after heavy rain and strong winds knocked out power to thousands, delayed flights, tied up traffic and flooded some roadways.

After the second in a series of storms slammed the region Friday, scattered showers are expected Saturday before a third storm strikes Sunday morning, according to the National Weather Service.

A flash flood watch will remain in effect for most of the San Francisco Bay Area and the Santa Cruz Mountains throughout the weekend. The storms could cause rock and mud slides in areas already saturated and affected by wildfires this summer, said NWS forecaster Diana Henderson in Monterey.

"It's not a super storm by any measure, but this is pretty significant," Henderson said. "We should see periods of moderate to heavy rains."

Friday's stormy weather may be behind the death of a Pacific Gas & Electric worker in West Sacramento who was killed after his truck crashed into a traffic signal pole during the stormy weather.

Friday's storm delayed flights at San Francisco International Airport and knocked down a large tree that smashed a car and blocked a busy street for hours in the city's affluent Pacific Heights neighborhood.

The North Bay was seemingly hit the hardest, as parts of Sonoma County received more than 7 inches of rain and areas in Napa County received nearly 6 inches, Henderson said.

With rain expected all weekend long, Tony Negro, a contractor from Penngrove, Calif., in Sonoma County, said he is worried about water flooding his workshop.

"I'm on my way to get some sand bags," he said.

Thousands of people were without power in that area after an outage that also affected the San Francisco-Oakland Bay Bridge. The suspension span of the bridge was briefly in the dark as traffic was backed up longer than usual because of rain and strong wind gusts.

Also, a mudslide shut down a stretch of Highway 84 east of Fremont, the California Highway Patrol reported. There was no estimate on when it would reopen.

In Sacramento, an empty big-rig jackknifed in the southbound lanes and struck the median divider on Interstate 5 south of downtown Friday morning, the CHP said.

"I would definitely say it's weather-related. The reports came in that he hit a water puddle and hydroplaned and couldn't correct," CHP Officer Mike Bradley said. "A lot of high-profile vehicles, especially the lighter ones, are getting windblown and having some problems maintaining their lane."

No one was injured in the crash on I-5, California's main north-south highway. But a second vehicle also was damaged and had to be towed, while workers cleaned up diesel fuel spilled from the tractor-trailer.

In West Sacramento, police say wet conditions may have been a factor when a PG&E worker died after he lost control of his vehicle and slammed into a traffic pole. PG&E workers at the scene told KCRA-TV that the driver had been working overtime and was returning from Clarksburg in Yolo County.

In Los Angeles, conditions were wet and gloomy as downtown skyscrapers disappeared in low-hanging clouds.

Elsewhere in the West, a state of emergency was declared in Reno, Sparks and Washoe County in Nevada due to expected flooding as a storm packing heavy rain and strong winds swept through the area. Reno city spokeswoman Michele Anderson said public servants would be working overtime through the weekend to control what's expected to be the worst flooding there since 2005. The National Weather Service issued a flood warning along the Truckee River.

The weather also prompted cancellations of Christmas parades and tree lightings in Sparks and Truckee, just across the border from California.

Also, a storm rushed through southern Oregon this week, lingering inland over the Rogue Valley and dropping record rainfall. It largely spared coastal Curry County and its southernmost city, Brookings, which were still recovering from a storm this month.

"We are still vigilant for landslides and road closures and trees down, but so far ? knock on wood ? we are still good to go," Curry County Sheriff John Bishop said.

Forecasters said the region should expect more storms over the next few days.

America, Syria and the State of Child Soldiering 2012

The photographs of Syrian teenagers holding Kalashnikovs with cigarettes in their mouths?may at first look like a romantic depiction of young rebels, but they are evidence of a tragic violation of international law and a moral failure for the Free Syrian Army. Syria?s civil war is averaging about 4,000 dead a month over its 20-month duration. That number in a country of 25 million mirrors the heights of the Iraq civil war. This would be the equivalent of roughly 50,000 killed monthly were Syria the size of America.

Yes, it?s a very, very violent war. But of all the human rights being violated in Syria, one has been overlooked: the use of child soldiers by the Syrian rebels.

A report issued this week by Human Rights Watch is a reminder that the Free Syrian Army is losing its moral high ground.

?All eyes are on the Syrian opposition to prove they?re trying to protect children from bullets and bombs, rather than placing them in danger,? said Human Rights Watch?s Priyanka Motaparthy in a press release accompanying report. ?One of the best ways opposition military commanders can protect children is to make a strong, public commitment against use of children in their forces, and to verify boys? ages before allowing them to enlist.?

Post-election, the United States is now looking at what expanded role it will play in Syria. No matter who won in November, it was a given that the U.S. would take a more activist role in Syria?s civil war. The stakes are too high not to, with American allies on all sides and our nemesis Iran backing Syrian dictator Bashar al-Assad?s brutal siege.

If America is to claim a moral high ground as a global leader, it must adhere to its own laws and stop supplying money to states that use children in warfare. That includes taking a harder line with the Free Syrian Army.

At a minimum, it looks like NATO will approve Patriot Missiles for Turkey and a more cohesive attempt to arm and legitimize the Syrian opposition. A no-fly zone is also being discussed. That would likely lead to an air war, given Syria?s anti-aircraft defenses.

One role the U.S. will likely not play in Syria is enforcer of child soldering international law. The U.S. counts six of the seven states that use child soldiers as allies: South Sudan, Somalia, Burma, Yemen, Libya and Congo. (America does not support Sudan, the other state named.) In the cases of Congo, South Sudan, Yemen and Libya, this represents a violation of the Child Soldiers Prevention Act passed by Congress in 2008, which bans military aid to states using children to fight wars.

By that standard, the Obama administration is complicitly committing war crimes.

The problem isn?t just with states whose armies we support. It?s with new allies too. President Obama visited Burma this month in the first-ever trip by a U.S. head of state. Burma has ?the largest number of child soldiers in the world. Thousands of children serve in Burma?s national army,? according to the International Herald Tribune. But while in Burma neither Obama nor Secretary of State Hillary Clinton brought up the issue publicly, though behind closed doors they did press for further military ?reforms.?

Of course, sending boys to war is not just an American issue. There are 300,000 child soldiers in the world, which would be tied with Thailand as the 15th largest standing army in the world.

But if America is to claim a moral high ground as a global leader, it must adhere to its own laws and stop supplying money to states that use children in warfare. That includes taking a harder line in Syria with the FSA.

War on al Qaeda is not indefinite: Pentagon lawyer

WASHINGTON (Reuters) - The U.S. military campaign against al Qaeda should not be seen as a conflict without end, the Pentagon's chief lawyer said on Friday in a speech that broached a rarely discussed subject among U.S. officials.

The Defense Department's highest-ranking lawyer, Jeh Johnson, predicted al Qaeda would some day be so "effectively destroyed" that the United States would no longer say it is in an armed conflict. A text of his remarks to be given at Oxford University in England was made available to Reuters in advance in Washington.

The U.S. government points to the existence of an armed conflict as the legal underpinning for the indefinite detention of the global militant group's members and allies and for drone strikes in places such as Pakistan.

Johnson's remarks could ignite a global political debate with arguments from both the left and the right.

The speech to the Oxford Union did not forecast when such a moment would arrive because al Qaeda and its affiliates in Yemen and elsewhere remain a danger, he said.

But Johnson tried to frame the discussion with what he called conventional legal principles rather than a new legal structure emerging from the September 11 attacks.

"Now that efforts by the U.S. military against al Qaeda are in their 12th year, we must also ask ourselves: How will this conflict end?" said Johnson, an appointee of U.S. President Barack Obama.

Johnson delivered the remarks in Oxford as prepared, a spokesman said.

Johnson has been mentioned as a possible U.S. attorney general to succeed Eric Holder in Obama's second term. A former New York corporate lawyer and federal prosecutor, he has been at the center of internal administration debates on national security since he arrived at the Pentagon as general counsel in 2009.

An "open end" to the conflict has been a defining feature of what then-President George W. Bush called a war on terror beginning with the September 11 attacks that destroyed New York's World Trade Center, damaged the Pentagon and killed 3,000 people.

Three days after the attacks, Congress authorized force against all "nations, organizations or persons" who planned them or who aided the planners.

'TIPPING POINT'

In courtrooms, congressional hearings and executive orders, U.S. officials with rare exceptions speak of a conflict with no obvious end point.

"I think one day they will be defeated, but it's not going to happen any time soon," Senator Lindsey Graham, a Republican, told The Huffington Post website this week.

U.S. Defense Secretary Leon Panetta, Johnson's boss, said in a November 20 speech that U.S. forces had decimated al Qaeda's core and made progress in Yemen and Somalia, but needed to avert militant gains in Mali and Nigeria.

On Thursday, Panetta said al Qaeda fighters are still trying to make inroads in Afghanistan, which was the group's primary base of operations in 2001.

By asking how the conflict would end, Johnson could provoke a public conversation that gets more specific.

"There will come a tipping point," he said in the speech, "a tipping point at which so many of the leaders and operatives of al Qaeda and its affiliates have been killed or captured, and the group is no longer able to attempt or launch a strategic attack against the United States," that al Qaeda will be "effectively destroyed."

"At that point, we must be able to say to ourselves that our efforts should no longer be considered an 'armed conflict' against al Qaeda and its associated forces."

Under that scenario, law enforcement and intelligence agents would go on pursuing individual militants or groups - even those who are inspired by al Qaeda's ideology - with the military in a reserve role.

"'War' must be regarded as a finite, extraordinary and unnatural state of affairs," Johnson said. "We must not accept the current conflict, and all that it entails, as the 'new normal.' Peace must be regarded as the norm toward which the human race continually strives."

But what to do with detainees not charged with crimes - such as some of those held at the Guantanamo Bay U.S. Naval Base in Cuba - might still be a slow process, Johnson said.

In one of 25 footnotes to the written remarks, Johnson cited a U.S. Supreme Court ruling from 1948 that allowed the detention of German nationals for six years after fighting with Germany ended.

Johnson is the first Obama administration official to say clearly that ideological kinship alone is not enough to make someone part of the armed conflict, said Karen Greenberg, director of the Center on National Security at Fordham University in New York.

"You cannot just have the ideas associated with al Qaeda and be considered part of al Qaeda. It has to be an organizational tie."

The speech shows the administration could move in a new direction after Obama was reelected on November 6, she said.

The timing "has everything to do with the election and maybe we'll see some real headway in terms of ending this war, ending this emergency state," she said.

Johnson was both optimistic and legally correct in saying the conflict would eventually end, said William Banks, a Syracuse University law professor

"It has not been said in this decade-plus since 9/11, that we might be looking at that posture of a state of peace as the default," he said.
